Notice of Intention to Discontinue Roads and Sell Land

Moorabool Shire Council (Council) gives notice under section 189 of the Local Government Act 1989 (Act) that it intends to sell part of the land at the corner of Gisborne Road and Russells Road, Coimadai, being:

  1. the parcel marked ‘Lot 1 TP386574D’ on the plan below and contained in certificate of title volume 6038 folio 516; and
  2. the 3 parcels marked ‘’Closed Government Road’ on the plan below, being former government roads which are vested in Council pursuant to section 526 of the Local Government Act 1958,

(together, the Land).

Council acting under clause 3 of Schedule 10 to the Act also proposes to discontinue the roads shown hatched on the plan below, being:

  1. the whole of the land contained in certificate of title volume 11390 folio 154; and
  2. part of the land contained in certificate of title volume 9937 folio 049,

(together, the Roads), and to sell the discontinued Roads together with the Land.

The proposal is for Council to sell the Land and the discontinued Roads to Hanson Construction Materials Pty Ltd ACN 009 679 734 (Purchaser), being the registered proprietor of 16 Russells Road, Coimadai, on the following terms:

  1. the sale price will be not less than the market valuation held by Council; and
  2. as a condition of the sale, the Purchaser will be required to consolidate the titles to the discontinued Roads and the Land with the title to the adjoining land owned by the Purchaser, within 6 months after settlement.

Any person may make a submission on the proposal under Section 223 of the Act. The closing date for submissions is no earlier than 28 days after the publication of the notice.  Friday 1 February 2019 at 5.00pm will be the closing date for submissions.

All submissions will be considered in accordance with section 223 of the Act.

Any person requesting to be heard in support of his or her submission is entitled to be heard before Council (or a Committee established by Council for this purpose) or be represented by a person acting on his or her behalf, and will be notified of the time and date of the hearing.

After considering all submissions, Council will decide whether or not to proceed with the proposal.
