Discontinuation of the portion of road known as River Drive, Maddingley

Moorabool Shire Council, acting under Schedule 10 Clause 3 of the Local Government Act 1989 (the Act) proposes to discontinue the portion of road known as River Drive Maddingley.

As highlighted on the plan provided below, this small portion of road was created on PS702772F, being Stage 5A1 of the development. At the time a small road stub was created for access into the future Stage 6.  The design for Stage 6 has changed since Stage 5A1 was registered and River Drive, Maddingley now enters Stage 6 approximately 30m north-east of its original location.

On Wednesday 7 February 2018, Council formally authorised officers to give public notice in accordance with section 207A of the Act of its intention to discontinue the portion of road known as River Drive, Maddingley as shown above under section 206 and Schedule 10 Clause 3 of the Act.

Any person may make a submission to the Council in relation to the discontinuance of the portion of River Drive, Maddingley in accordance with Section 223 of the Act.

Written submissions should be forwarded to the Chief Executive Officer, Moorabool Shire Council, P.O. Box 18, Ballan, 3342, and received by Council by 4.00pm on Tuesday 13 March 2018 and will be considered by the Council (or a Committee of the Council appointed for that purpose) in accordance with Section 223 of the Act.

Any person who wishes to be heard in support of a submission should indicate in the written submission that he or she wishes to be heard. Any person requesting that he or she be heard in support of a submission is entitled to appear before a meeting of the Council (or Committee) either personally or by a person acting on his or her behalf and will be notified of the time and date of the meeting.

Submissions made under section 223 of the Act are not confidential and:

  • Will be incorporated in full (including any personal information) into the agenda and minutes of any Council or committee meeting at which the matter is considered;
  • Will be provided on Council’s website as part of any relevant Council or committee agenda and minutes.
