Register an aquatic facility

In December 2019, the Public Health and Wellbeing Regulations 2019(PDF, 713KB) replaced the Public Health and Wellbeing Regulations 2009.

This means all Category 1 aquatic facilities must now be registered with Council.

What is a Category 1 aquatic facility?

A Category 1 aquatic facility means a swimming pool, spa pool or interactive water feature that is:  

  • used by members of the public, whether free of charge or on payment of a fee
  • used in association with a class or program that is offered free of charge or on payment of a fee
  • located at the premises of an early childhood service, school or other educational institution
  • located at premises at which residential aged care services are provided. 
  • located at a public hospital
  • located at a multi-purpose service
  • located at a denominational hospital
  • located at a private hospital
  • located at a privately-operated hospital within the meaning of section 3(1) of the Health Services Act 1988

What is a Category 2 aquatic facility?

A Category 2 aquatic facility means a swimming pool or spa pool that is used by members of the public and is located at the following premises:

  • a residential apartment complex
  • a hotel, motel or hostel.


Category 1 and 2 aquatic facilities must comply with the following:

  • water quality standards
  • record-keeping
  • response procedures for non-compliant water quality
  • requirements for aquatic facilities suspected or implicated as a source of infection

The regulations now include new types of aquatic facilities that may pose a risk to public health. They include a risk-based classification of aquatic facilities as either Category 1 or Category 2.

Category 1 and 2 aquatic facility operators are required to comply with the regulations, including managing health risks associated with water quality.

The Water quality guidelines for public aquatic facilities - managing public health risks will be updated to support the regulations and provide operational guidance for maintaining water quality.
